These Terms of Service (the "Terms") constitute a legally binding agreement between you (whether as an individual or on behalf of an entity, hereinafter "you") and Yiwu Heluo Network Technology Studio (operating under the trade names "Holos AI" and "Holos Labs", hereinafter "we", "us", or "our") regarding your access to and use of the "Holos" mobile application (the "App") and its related web services.
By downloading, installing, or using the App, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree with any part of these Terms, please stop using the App immediately.
Unless otherwise stated, the App and its source code, databases, functionality, software, UI/UX design, audio/video, text, and graphics (collectively, the "Content") and the trademarks and logos ("Marks") contained therein are owned or controlled by us and are protected by copyright and trademark laws. "Holos", "Holos AI", and "Holos Labs" are proprietary marks of Yiwu Heluo Network Technology Studio.
Use of advanced features may require account registration via Google Sign-in or email. You are responsible for keeping your account password confidential and for all activities that occur under your account. We reserve the right to remove, reclaim, or change a username if we determine it to be inappropriate.
In-App Purchases: Certain features are charged on a subscription basis ("Premium Plan") and settled via Google Play Billing.
Auto-Renewal: Unless you cancel via your Google Play account settings, your subscription will automatically renew at the end of each billing cycle.
Refunds: All refund requests are handled through the Google Play Store in accordance with Google Play's standard refund policy.
You may not use the App for any illegal or unauthorized purpose. When using the App, you shall not:
This App uses Artificial Intelligence (AI) and Large Language Models (LLM) to analyze chat context and generate text suggestions. You explicitly acknowledge and agree that:
To the maximum extent permitted by applicable law, Yiwu Heluo Network Technology Studio (Holos AI / Holos Labs) and its directors, employees, or agents shall not be liable for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages (including loss of profit, revenue, or data) arising from your use of the App, even if we have been advised of the possibility of such damages.
You agree to indemnify and hold us and our affiliates, directors, and employees harmless from any third-party claims, losses, liabilities, and expenses (including reasonable attorney's fees) arising from your violation of these Terms, your improper use of the App, or your violation of third-party instant messaging platform terms.
Except where mandatory laws provide otherwise, any disputes arising from these Terms or the use of the App shall first be resolved through friendly negotiations. If negotiation fails, the dispute shall be submitted to the China International Economic and Trade Arbitration Commission (CIETAC). If consumer protection laws in your jurisdiction grant you specific dispute resolution rights (e.g., the EU Online Dispute Resolution platform), these Terms do not affect the exercise of such mandatory rights.
We are not responsible for delays or failures in performance resulting from events beyond our reasonable control (including, but not limited to, natural disasters, government actions, network or telecommunication interruptions, or changes in third-party platform policies).
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue to be fully valid and enforceable. These Terms (together with the Privacy Policy) constitute the entire agreement between you and us regarding the use of the App and supersede all prior verbal or written agreements.
These Terms and your use of the App are governed by and construed in accordance with the laws of the People's Republic of China, excluding its conflict of law principles. However, if the laws of your residence as a consumer grant you mandatory protections (e.g., rights in EU consumer law that cannot be excluded by agreement), such mandatory provisions shall prevail.
These Terms remain in full force and effect while you use the App. We reserve the right to deny access to and use of the App at our sole discretion, without notice or liability, for any reason (including breach of these Terms).
